Hong Kong has adopted the Common Law system for a long time. There are basically two types of criminal jurisdictions in Hong Kong:
1. Trial on indictment
An Indictable offence is an offence which can only be tried on an indictment after a preliminary hearing to determine whether there is a prima facie case to answer. For indictable offences, the accused normally has the right to a jury trial, unless he or she waives that right.
2. Trial by Summary
A summary offence, also known as a petty crime, is a criminal act in common law jurisdictions that can be proceeded with summarily, without the right to a jury trial and/or indictment.
Courts of Hong Kong is mainly divided into two divisions:
1. The Higher Courts - which includes the Court of First Instance, The Court of Appeal and the Court of Final Appeal. The Court of First Instance only deals with indictable offences.
2. The Lower Courts - which includes the District Court and the Magistrate Courts. Both the District Courts and the Magistrate Courts deal with indictable offences and the Magistrate Courts would also deal with Summary Offences.
