租客無交租 ... 搵佢唔到 .. 點算 ??

簽左一年約 ... 交左1個月按金同2個月
兒家租到第二個半月
佢已經遲左半個月無交租
我同地產商追左佢電話半個月都無人聽 ..


咁我可以點做 ??

wait at ur flat door lor at night after work for a few days, he should go back home and sleep ¸
if you see him finally, see if he is willing to pay the rent,
if not, ask him when he is able to pay

1) you should wait at your flat door or the entrance of your building everyday
2)call him everyday
3)ask the security if he sees him or not?
4)see if he takes out the letters from his mailbox to see if he goes back home
5)ask 地產商 to always go to your flat to see if he is there in the afternoon when you are at work( you tell him you are gonna pay them 5 to 10 % of the rent of this month, then they will go it)
6)leave a paper at the door to tell him he have to pay the rent before a deadline

If the problem persists, let say you can`t find him,
here is the solution
A)you go to police station, you tell the guy is missing and you suspect he is dead in your flat or you say downstair say there`s water leaking and you don`t see the guy and you have to go in and check the inside of the flat, therefore, you go to your flat with policemen and you use the spare key, you go in and see if he is dead inside or not. so, you can finally go in to see if something happens.

if he shows up finally, and he doesn`t want to pay, then you tell me what happens, then i propose you solution,

欠租、住客失蹤、單位被分租、惡租客......,往往給業主來很大的困擾。根據現時業主與

租客(綜合)條例,收樓程序頗為繁複,需時亦久,不過,業主不應怕死麻煩,當遇到租客

拖欠租金,應立即進行訟訴,縮短收樓時間,減低損失。

假若租客最後[玩失蹤],業主更可向法庭申請凍結租客的銀行戶口或資產以賠償欠租

業主遞交申請收樓書(表格22)

全部過程約須四個月,但會因應不同個案及業主的積極程度而有差異

土地審裁處

審裁處向租客發出通知書,租客收到通知後需在14日內提交反對申請收樓書。

如租客無提出反對,業主可申請缺席裁判,並申請收樓令,通常法庭七日內批出。

收樓令批出,業主需在單位外貼通知信通知租客 ,業主需連續貼紙3天.收樓會有4星期通

融期,期間租客需交回欠租(如租客交回欠租需收回)。

通融期過後,租客仍未交回欠租,業主可向法庭申請收樓傳票。

傳票批出後,業主須安排在執達吏的 陪同下往單位通知租客遷出及交回欠租。

兩星期後業主與執達吏須作第二次探訪,以確定租客是否已遷出,如租客已遷出,業主可

完成收樓,如租客仍不肯遷出,業主可申請封樓票。

審裁處約兩個星期內會批出封樓令,收到封樓票後,業主需再安排與執達吏及警衛陪同下

進行封屋,如遇到租客反抗,應由執達吏報警,請警方協助,勸喻租客離開單位,封屋

後,處理方法有三個。

業主與租客議定日期,取回財物但需交回欠租及聘請警衛的費用。

安排拍賣租客之財物以保償欠租及聘請警衛的費用。

即時封樓,所有屬於租客 的物品必須搬走,欠租日後再追討。

上述法律程序由於頗繁複,加上租客在收樓令通融期間如交回欠租,則仍可繼續在單位內

居住,假如租客每次用同一方法,業主會不勝煩擾,因此,為免麻煩,選擇好租客至為重
