X offered to buy Y's horse for $50000 by a leeter whicj said:'If I hear no more about him, I consider the horse mine at that price'. Y did not reply to the letter but indicated to an auctioneer that the horse was to be kept out of a forthcoming sale. The auctioneer sold the horse bu mistake and was sued by X. Would X succed?

Silence could not amount to an acceptance, Felthouse v. Bindley [1862]. There should be no contract between X and Y.

Whether the auctioneer sold the horse by mistake is not a matter for X.
