第 二 十 三 條

香 港 特 別 行 政 區 應 自 行 立 法 禁 止 任 何 叛 國 、 分 裂 國 家 、 煽 動 叛 亂 、 顛 覆 中 央 人 民 政 府 及 竊 取 國 家 機 密 的 行 為 ， 禁 止 外 國 的 政 治 性 組 織 或 團 體 在 香 港 特 別 行 政 區 進 行 政 治 活 動 ， 禁 止 香 港 特 別 行 政 區 的 政 治 性 組 織 或 團 體 與 外 國 的 政 治 性 組 織 或 團 體 建 立 聯 繫 。

Article 23

The Hong Kong Special Administrative Region shall enact laws on its own to prohibit any act of treason, secession, sedition, subversion against the Central People's Government, or theft of state secrets, to prohibit foreign political organizations or bodies from conducting political activities in the Region, and to prohibit political organizations or bodies of the Region from establishing ties with foreign political organizations or bodies.

闡述：就叛國、竊取國家機密、煽動叛亂等問題立法。咁點解會有咁大反對聲音呢？係因為「 煽動叛亂」等字眼係好vague同定義不明的，好多野都可以歸納成煽動。如：香港是時事評論節目、社評、叫人去上街遊行係唔係煽動呢？一但立法，香港的言論自由會受影響，所以先會有咁多人反對。

原法例非常複雜，簡而言：
香港基本法第二十三條是香港基本法中一條就香港境內有
關國家安全，即叛國罪、分裂國家行為、煽動叛亂罪、顛覆國家罪及竊
取國家機密等多項條文作出立法指引的憲法條文。
