一般大厦或屋苑只有業主委員會或業主立案法團其中一個。
業主委員會是由業主委託的管理組織。
而業主立案法團是法定組織(法團)，層次上業主委員會高，職能相似。是由業主組成，此處對業主有嚴格定義，非一般所講，能否成立業主立案法團就要看公契。

「引致這些屋苑難以成立法團的法律問題源於它們的公契通常沒有向業主分配不可分割業權份數。換言之，這些屋苑的業主是每個子地段的唯一擁有人，而非整個獨立屋苑的共同擁有人。因此，這些屋苑無法在現行條例下成立法團。」
