Village House
Village House is in the New Territories of Hong Kong. The male heirs of the original villagers have obtained the right to build new houses, in legal terms this is expressed as small village house.
History
After the 1967 rebellion and the decision by the government in the 1970s to develop the new territories, in order to obtain the support of the original villagers, the HK government at that time in December 1972 came up with the 'Small Village House Policy'. The required age was 18 years old and the paternal lineage had to be traced from 1890 into the village in the Ying Hor village in New Territory and they had to be a male descended from such a line, then every male can apply once for building a 3 tiered building (27 feet or 8.23 metres tall) within the approved area. The surface area of each tier must not be over 700 square foot without having to handover a land charge to the government.
The government also created a 'Limitation on Trading or Passing on'. Requiring that those original villagers who got a Ding House that if they wanted to sell on the Ding House or transfer it to non-original villagers, then they must inform the government and apply for a 'Replenishment Land Charge' and they must obtain a contract from a real estate agent outlining consent before they are able to carry out such transactions. The land that Ding Houses are built on usual are in the New Territory or Lai Island's villages or farmland. According to the New Territory Village Council's estimations, the amount of male villagers with the right to obtain a Ding House is 240,000
Revolution and Dispute
In August 1995 the Hong Kong Government reviewed the policy on the New Territory Small Village houses. Although according to section 40 HK Basic Law's the original villagers of the New Territory have a legal right under traditional law to still receive protection after the handover, but before 01/07/97 there was still a large amount of original villagers in the process of applying to the government for a Small Village House, which led to neglect on the Ding House application. The Land Regristry started a 'New Review on the Ding House Application Process' on 01/04/04 but due to the protest from the original villagers this was temporarily put on hold.
