I just bought a new Toyota corolla, but when i am lining up for the ATM drive through, somebody hit me at side, and when I talk to him(he is a mexican, and he don't have a US driver license but a Mexico driver license, he don't have proof of insurance, and I suspect he don't have it..I am not sure if he is Illegal immigrant too) but anyway I call the police and the file a case number for me,I file a calm w/ my insurance company but they think they can't do anything about it. since I just got libreity, so should I go ahead and sue the people who hit me, and will I get any money back?

If you only had liability, and no uninsured driver coverage, you must settle the problem with the other driver. If he doesn't have proof of insurance in the States, you will have to sue to get any benefit. If the police arrived, apparently the man is legal to be here, or they would have taken him into custody. It's a civil matter for the courts to decide, it may be easier to work out a payment arrangement with him, sign a contract and if he fails to pay, then go to court.

I don't what to offend you but are you crazy or what. I know for a fact that anyone and everyone that gets hit by an illegal gets the raw deal every time.

LOL.. a Mexican with insurance? Not likely. If you try and sue him you probably won't even be able to find him anymore. Or he'll just deny he even hit you.

I assume when you say "new toyota" , you're talking about new to you. If you bought a brand new car, the dealer would not let you leave the lot without collision coverage. I also assume you paid cash, since any loan would have to have collision insurance. Be sure to file a state report so the other person will get their license suspended until they pay you. Even if they don't have a valid license and get stopped they have serious problems.

You have a brand new car, and only put liability on it? Why on earth did you do that? Obviously you paid cash for the car, since any financing would require full coverage insurance. So, looks like you pay for the damage out of your pocket. Can you the people who hit you? Of course, and you would probably win also, but then how would you collect from them unless you know where they work, or what assets they have?

Other then filing with your insurance company , suing him would be your only other recourse.
Make sure you get 3 written estimates , a copy of the police report , pictures from all sides of the damage to your car and also pictures and drawings of where the accident happened and how. Get witness statements too.
or you could just pay for the damages yourself and forget about too. ( if they are very minor)
