借約有沒有法律約束力???(送20分)

你所指借約的意思如果是借款合約/借據, 都有法律約束力, 當然內容或所定的條文清楚與否, 將有機會影響訴訟時的勝素, 但一定有法律約束力, 即使沒有見證(witness)或打厘印(stamp at the IRD)

至於如你借層樓給朋友住所簽的文件, 就睇下你有冇收租金/錢, 如有的話, 就等於租約, 即使沒有stamp,所以也有法律約束力的

係有的，由于借約在法律上，視為一証据，通常情況下，都係私文書 個一種，在法庭上，具有証明力。而且，依据法律，消費借貸﹝借錢﹞和租賃，以私文書﹝借約﹞作成即可。

To make it a legal binding 法律約束力 contract, you have to make out a formal agreement and signed by both parties with witnessed to the signatures. The agreement should then be taken to Inland Revenue Department for stamping to make this a legalised document. If no stamping, the agreement could not be tabled before a judge in a court.
