從來都沒有合約，如果可以取錢，人人地咁，d人就好..

To constitute a valid (有效)contract, the following must all be present:
offer
acceptance
sufficient consideration
intention to create legal relations
legality, and
Capacity to make the contract

因此，合約不存在

很有趣的問題。
首先，合約的定義按Treitel教授所說，一份能夠被法庭所執行的協議。
合約法的規則，要有「邀約」(offer)，即你邀請對方接受合約；對方也要有「受約」(acceptance)，之後，再看雙方有否建立法律關係的意圖 (intention to create legal relation)，這點很多時視乎兩者的關係而定；最後，是否有「代價」(consideration) 所在。
雖然對方並沒有受約，然而另一方真的付出了勞力，法庭多數會判對方付一個合理價錢的。
