Potential Liabilities
Although owner-sellers are not real estate professionals, Oregon law and the courts often hold these sellers to the same standards as professionals who practice every day. These standards require all home sellers to complete certain steps in the sale of a home, and they expose sellers to various liabilities when they violate the law, even if accidentally.
Following is a list referring to some of the potential risks and liabilities that result from selling a home. Most of these items are rooted in requirements of Oregon law, which apply to everyone who sells an owner-occupied residence containing from one to four units. Any one of these items could result in a lawsuit that could cost many thousands of dollars. (This list is not all-inclusive.)

Improperly executed earnest money agreement and/or purchase contract.

Failure to comply with residential property disclosure laws.
3.
Failing to provide adequate disclosure of issues that buyer feels are important.
4.
Accusations of unlawful detainer or fraud due to mishandling of earnest money deposit or other security.

Improper conveyance of title.

Oil tank problems or other pollution hazards.

Failing to register and properly tag drinking water well as required by law.

Failing to perform according to the precise terms of the sales contract.

Disputes over definitions of real property and personal property.

Improper completion of repairs, especially lender-required repairs.
15.
Disputes over certain parts of the premises not included as part of the sales contract.

Loss of property or property value due to fraud by illegal drug manufacturers or other criminals.
