de facto in Australia !! please help

Currently i stay in Australia with my bf since last June, We plan to apply de facto visa ,but have some question as below .
1) i have 4 years old son in Hk ,i got full custody so we like to bring him with me as well , but i need my ex to sign paper for me or not ( coz my ex will not accept i bring him to Australia )
2) if my ex don't let me bring my son , i think i will fight with him in court , so i should fight him in court first or i send the application first ?

You have to live with your boyfriend for one year before you apply for De Facto visa. So you apply this year August. I think you should ask your ex-husband to sign first and if he doesn't, take him to court first, after you win in court then apply for De Facto visa.

For your ex-husband part, the best is negotiation and discussion. He would want the best for his son. Explain to him that he would have better facilities, air, space in Australia. AND MOST important of all, you would take your son to HK every year or something so that he can see his son as well. Of course, he does not want to lose him. You can also set up internet video conference so that he can see his son and send him photos with emails. Assure him that he can always come to Australia to see his son.

Going to court is ALWAYS the last option. It is costly and time-consuming.

BTW, if you have full custody of your son, why does he need to sign the paper to your son to go to Australia??? You'd better check with Australian Consulate. I dont remember the application form asking for any paper signed by ex-husband ... Double-check the application form to see what is required.
