精神病患者所簽定的合約是否有法律效力??

根據contract law
Mentally Disordered Persons
Mentally ill people who have been certified uner the Mental Health Ordinance (Cap.136) will have their contracts for sale of pro[perty set aside by the courts and the affairs of the person will usually be delegated to a represntative.
Mentally ill people who have not been certified may avoid liabilit under a contract of they can prove that, at the time of the contract, the other party knew of their disability and the nature of the disability meant that they were unable to understand the effect of the contract.


即是精神病人簽的，唔一定是void的contract
如果，對方有監護人看住，做代表
就是一個可以void的contract

咁你話，得佢一個人，咁就唔是有監護人
不過，仲有，佢有冇能力明白那個contract

因為有d人精神有問題，一時好清醒
咁就是valid(有效)的contract

如果唔清醒
就是void(冇效)

輕微的會有，但嚴重的就沒有。
