The duties of an employer being implied in the contract by Employment Ordinance.
Express Terms(明示條理):
Any term which denies or reduces the rights and benefits stipulated(規定) in the Employment Ordinance will be void.
Standard Terms:
Duration, position, place of work, working hours, wages, rest days, holidays. Annual leave, maternity benefits, sickness allowance, probation period, termination, end of year payment, mandatory provident fund, work arrangement.
Under (2). Grant the following benefits to employees:
(a).1 rest day in every period of 7 days.
(b).12 statutory holidays every year with holiday pay
(equivalent to an employee’s normal wages after the employee has been employed for 3 months.)
