You own a small construction business. One of your workers is 55 years old and had heart bypass surgery about six months ago. He wants to come back to work, but you are concerned about that he will not be able to handle the job's physical task.
What should you do?
What are you prohibited from doing?
What laws apply in this case?

This approach should be appropriate

Step-1 Conduct a job analysis of the worker for what essential tasks, duties, and responsibilities involved in performing the job--Job description, and then describe what skills, knowledge, abilities, physical exhaust and output to order to perform his tasks and duties

Step-2 Call for professional advices with no bias, you may call for 2-3 medical doctors' advice by reviewing his job analysis report if the health of the worker is still fit to performing his tasks and duty. Or in contrast, the worker is requested to submit such professional advice to prove his health.

Step-3 Consult to related insurance firm if required

Step-4 If both outcomes of the step-2 and 3 are negative, and then he should resign his post according to the prior established employment contract which governing what duties and tasks he should perform

Step-5 if both outcomes of the step-2 and 3 are positive, then he have right to remain his post in performing related tasks and duty, however for the sake of his health concern with your kind advice that he is requested either for early retirement with fair compensation, or job rotation to the job with low physical output-- new staff trainer or clerical worker, or consultant. Of course his pay may be not the same!
