口頭承諾有效嗎?(關於租鋪,請幫我!)

我在某一個新商場租一個店鋪,由於之前商場未起好,所有租户簽臨時合約只是看平面圖去選鋪,簽臨時合約之前他們說有六成實用面積,但前天剛度完實用面積,只有4成,但我們簽的臨時合約只有我們租的鋪號及租金等,無仔細說有多少尺,現在我們有六個租户都不滿,咁樣貨不對辦有無權取回訂金取消租約,或要求減租呢?就快要簽正式合約,我地有無權去争取呢?應該點講呢?

Basing on the CONTRACT LAW, verbal contract is acceptable. If you have documents that can prove your words, you can sue them for compensation. You can appeal to Lands Tribunal that it determines disputes arising from(處理以下糾紛)
- Compensation amount for resumption of land(沒收土地賠償金);
- Assessment of rateable value of public / private premises(評估物業差餉及估值);
- Landlord and Tenant (Consolidation) Ordinance regulating repossession of tenanted premises and permitted change of rent(業主及租客條例);

Please note that, the rule governing formation of contract consist of 7 Legal elements of valid contract. Offer + Acceptance + Consideration + Intention + Capacity + Formality + Legality. With the concept of "Formality", it clearly state that a contract is valid in form of written (on paper or by e-mail) and verbal.

Suggestion, you should contact other renter for any signed or approval documents so as the sue them for compensation!
