貪污的問題

現時香港有關貪污的法例，都並沒有將香港特首列入規管範圍的，所以即使他貪污都不會被起訴的。

Chief Executive of Hong Kong does not have immunity from prosecution, regardless what crime he commits. Unlike members of Legco(立法會), they have the immunity during LegCo Meetings. [See below]
The other category of people who have immunity from prosecution are those who are Diplomats(外交官). They've rights under the International Law, Vienna Convention on Diplomatic Relations 《維也納公約》 to be immune during their diplomatic relation in a foreign country.

任何議員─


(a) 在前往立法會或任何委員會會議途中，在出席會議或會議後回程中，可免因民事債項(如訂約承擔則構成刑事罪行的債項除外)而遭逮捕；
(b) 在出席立法會或任何委員會會議時，可免因刑事罪行而遭逮捕。

　香港的特首如果干犯貪污，應不會獲得豁免起訴。因為按照中央政府的規定，腐敗的官員須即時被免職，正如前上海市委書記陳良宇般的人馬都無法倖免。
　香港政治不像台灣，領導人有無上權威；如果香港市民唾棄你的統治，像董建華和他信一樣的領導者都要黯然下來。
