大業主收回舖位,租戶可要什麼賠償?

小弟在年頭頂咗間舖頭做吓小生意.同大業主簽訂兩年合約.但最近得知有大財團收購.

如果大業主要收回舖位.那麼他會賠償什麼給小弟?而小弟又可以提出什麼要求?

而當初的頂手費,單簿,膠袋,做招牌的費用又可否歸納賠償之內?

我曾經試過,業主只會跟合約上作出賠償,如果你係一年生一年死約,未過一年死約,業主其實要賠償解約餘下月數之租金,及發還上下按金,但係如果租約無列明,業主通常都會拖延到約滿.當你過咗死約,業主只要一個月書面通知解除租約,你只可以取回按金,所以未必一定有得賠.
如果業主急趕收回舖位,你可以嘗試提出要求,但當然是合理既要求.
而頂手費是你同上手租客既協議,所以業主係唔會作出賠償,至於什項等費用,業主亦唔會賠償之內.

You can try to ask for these compensate, but he has no liability for that.

And their liability is only pay for your 2 years rent minus the time you had rent.

The best thing you need to do is talk to them. And do not scare them to bring this case to the court. I might let you know what to do after negotiation.
